These Terms of Service ("Terms") govern your use of the website located at shellpros.com (the "Site"), operated by Shell Pros Construction, LLC ("Shell Pros," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
1. About this site
The Site exists to share information about Shell Pros and its construction services, host our portfolio, and provide a way for prospective clients and job applicants to contact us. The Site is informational. It is not a substitute for a signed contract, proposal, or scope of work.
2. Estimates and proposals
Submitting a contact or estimate request through the Site does not create a contract or binding agreement. All construction work is performed only under a separate written agreement signed by both Shell Pros and the client, which controls scope, price, schedule, warranties, and remedies. Information presented on the Site (sample projects, timeframes, illustrative pricing, capacity, service areas) is for general reference and is subject to change without notice.
3. License and use of the Site
We grant you a limited, non-exclusive, revocable license to access and view the Site for personal, non-commercial purposes. You agree not to:
- Reverse engineer, scrape, or systematically download Site content.
- Use the Site to transmit spam, malware, or unlawful material.
- Submit false information through forms, or impersonate another person.
- Interfere with the Site's operation or attempt to circumvent rate limits or security controls.
- Use the Site or its content in any way that violates applicable law.
4. Intellectual property
All content on the Site — including text, photography, project imagery, logos, brand marks, layouts, and code — is owned by Shell Pros Construction, LLC or its licensors and is protected by U.S. copyright, trademark, and other laws. You may not copy, reproduce, republish, or use Site content without our prior written permission, except for personal reference or as expressly permitted by law (e.g., fair use).
5. Job applications
Applying to a posted role through the Site means you agree we may retain your application materials for evaluation, contact you about the role, and (with your authorization) follow up with any references you provide. Submission of an application does not guarantee an interview or offer of employment.
6. Third-party links and services
The Site may link to third-party sites or rely on third-party services (such as Vercel for hosting, Resend for email delivery, Cloudflare R2 for asset storage, and association websites in the footer). We don't control those third parties and aren't responsible for their content, policies, or availability. Linking to a site is not an endorsement.
7. Disclaimers
The Site and its content are provided "as is" and "as available" without warranty of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted access. We do not warrant that the Site will be error-free or that defects will be corrected. Construction warranties, where applicable, are governed exclusively by your signed agreement with Shell Pros — not by anything published on this Site.
8. Limitation of liability
To the maximum extent permitted by law, Shell Pros Construction, LLC and its members, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site — whether based in contract, tort, statute, or any other legal theory, and even if advised of the possibility of such damages. Our total aggregate liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100).
9. Indemnification
You agree to indemnify and hold Shell Pros and its members, employees, and contractors harmless from any claims, losses, or expenses (including reasonable attorney fees) arising out of your use of the Site or your violation of these Terms.
10. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Collier County, Florida, and you consent to personal jurisdiction there.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the Site after a change means you accept the updated Terms.
